Mark Roberts is an associate attorney, with an emphasis in complex litigation. His focus is on defense work in Personal Injury, Premises Liability, and Products Liability cases. He has handled all aspects of numerous cases, arbitrations, and appeals including written discovery, depositions, mediations, and trial. He has experience in personal injuries, property damages, construction, product liability, securities and financial services litigation, and professional negligence cases. Mark is also a Credential Mediator with the Texas Mediator Credentialing Association.
Mark completed his undergraduate studies at Southern Methodist University in Dallas, where he obtained both a BBA in Accounting and a BA Economics. After college, he worked as an internal auditor for one of the largest trust companies in Texas, before deciding to pursue his law degree. He earned his JD from St. Mary’s Law School in 1993 where he served as Articles Editor for the St. Mary’s Law Journal. Mark worked in a variety of small and large law firms in the Dallas- Ft. Worth Metroplex before joining Fletcher Farley Shipman & Salinas in 2011.
Notable Recent Cases:
Commercial real estate broker was accused of managing strip mall property where fatal shooting occurred. Asserted potential for bad faith filing and convinced plaintiff to voluntarily dismiss without any payment from client.
Stockbroker accused of mismanaging $10M portfolio. Stock broker could not explain million dollar discrepancies in several reports provided to Plaintiff. Obtained defense award of $0.00 at arbitration.
Minor was shopping at home improvement center when lumber display broke crushing the Plaintiff’s ankle. Home improvement center filed bankruptcy and minor proceeded against insurance proceeds. Tried case to verdict with no payout by insurer.
Structured annuity broker accused of negligently failing to structure guaranteed return of annuity to minor who subsequently passed away. Obtained summary judgment on behalf of client and successfully defended Plaintiff’s appeal of that summary judgment. Patterson v. McMickle, 191 S.W. 3d 819, 827 (Tex.App.-Fort Worth 2006, no pet.).
Attorney appointed as receiver by family court to take possession of grocery stores, sell same, and deliver proceeds of sale to court for distribution in divorce proceeding. Husband accused receiver of mismanaging property and improperly selling same. Summary judgment on issue of derived judicial immunity denied at trial court. Successfully reversed and rendered decision on appeal in favor of receiver.

Nonprofit Board of Directors accused of failing to provide members of non-profit water supply company with notice of annual elections which, in turn, resulted in improper seating of Board. Case settled for no payout by client after filing of motion for summary judgment.
Series of foundation repair cases where Plaintiffs filed suit in state court alleging negligent construction of residential construction. Client attempted to compel arbitration of these cases. During course of appeal of denial of Motions to Compel Arbitration, several of these went through mandamus proceedings to Texas Supreme Court. Texas Supreme Court ruled in accordance with client’s interpretation of various arbitration provisions. In re Olshan Foundation Repair, 328 S.W.3d 883, 887 (Tex. 2010)
