Mr. Johnson is head of the Labor & Employment Practice Group of Fletcher Farley and has more than 20 years of experience representing management and insurance carriers in employment litigation, arbitration, and administrative proceedings. For more than a decade, Mr. Johnson represented the largest employer in the DFW metroplex. His practice includes defense of employers in litigation and administrative proceedings in Texas and other states across the country. He prosecutes and defends companies and individuals in unfair competition, restrictive covenants, and misappropriation of trade secrets litigation and routinely consults clients in noncompetition agreements.
Mr. Johnson also has significant state and federal court experience in the prosecution and defense of business disputes, real estate, and commercial litigation matters.
Results for Clients:
Secured summary judgments in favor of corporations involving claims of discrimination based on age, race, sex, harassment, retaliation, national origin, disability, family medical leave, ERISA, and workers compensation retaliation.
Successfully obtained and defended numerous TROs, temporary and permanent injunctions in covenant not to compete, misappropriation of trade secrets, trade mark and unfair competition cases.
Successful defense of EEOC and litigation matters across the country for manufacturing and distribution client.
Successful defense of commercial airline in a Sabine Pilot wrongful discharge claim overturning a $5.8 million dollar verdict in Simmons Airlines d/b/a American Eagle Airlines v. Michael Lagrotte, 50 S.W.3d 748 (Tex. App. – Dallas 2001, pet. denied).
Preserving the Texas employment at-will doctrine and affirming summary judgment on appeal in Mike Friend v. CB Richard Ellis, Inc., 2009 Tex. App. LEXIS 1189 (Tex. App. Fort Worth 2009, no pet.).
Defense verdict in favor of Zachry Construction Company in a race discrimination claim before the American Arbitration Association.
Federal summary judgment and state court jury verdicts in favor of national clothing chain in state court workers’ compensation retaliation claim and federal FMLA claim. Wesley v. One Price Clothing Stores, Inc., 2003 U.S. Dist. LEXIS 14221 (N.D. Tex. 2003).
Successful defense of German nationals in a wrongful termination, breach of employment contract and partnership dispute involving damages claims in excess of $4 million dollars.
Successful prosecution and prejudgment garnishment of transportation brokers for fraud and theft of approximately $1 million dollars.
